What's New in the Thirteenth Edition of Minnesota Legal Ethics

The 13th edition of Minnesota Legal Ethics has updates and supplements from cases, articles, and opinions through March 31, 2023.  The treatise is free, online, word-searchable, and includes hot links.  The treatise comprises both commentaries on the various Rules of Professional Conduct and discussion of related professional responsibility topics, such as the attorney-client relationship, common law antecedents, and the history of professional responsibility in Minnesota.

The 13th edition includes a comprehensive revision of materials relating to rules governing attorney advertising, solicitation, and related communications.  These rules were extensively amended in 2022, and generally made more permissive.  Lawyers should review their marketing materials and practices in light of these changes.

The 13th edition also updates and comprehensively reviews discipline cases involving prosecutors.  Several commentators have contended that prosecutors should be disciplined more frequently, and the treatise provides citations and analysis that are necessary to consider this issue in Minnesota.

Like every new edition of the treatise, the 13th edition reports on and analyzes new ABA formal ethics opinions and positions taken in Minnesota by the Office of Lawyers Professional Responsibility and the Lawyers Board.  And like every new edition, the perspectives used involve the author’s experience as a discipline attorney, an ethics defense attorney, an advisory, and an ethics partner for twenty years at a major law firm.
