1.1 says a lawyer should keep abreast of
changes...including the benefits and risks associated with relevant
technology.
The language of the rule is often a good starting point.
Naturally, we might begin by asking, how does one keep abreast? Who’s
going to tell me what therelevant technologymight be? But, the language of the
rule was left intentionally
vague because the pace of change makes it impossible to reasonably anticipate the
relevant technology. So, instead, our starting point will
be ethics stories which highlight how everyday professional obligations intersect with
technology-enabled practices. Rather than firing off '60
tips in 60 minutes,' we'll focus on basic principles for managing
the pace of change, learning about developing technologies,
and staying competent in the legal tech arena.
