PM - Understanding Implicit Bias and Its Impact
Traditional thought has held that discrimination was always the result of
conscious and deliberate conduct. Current research has established that all
human beings are biased toward something, somebody, or some group, and that
these biases are normal and unintentional. Recent research shows that people are
making discriminatory choices against their own conscious belief that they are
being unbiased in their decision making. This research gives us awareness that
implicit bias exists, and that is a step in the right direction to reduce its
influence on our decisions. This is especially important in the practice of law,
where the fundamentals of fairness and impartiality are at the core of our
judicial system. This program will explore what implicit bias is, what the
sources of implicit bias are, its relationship to complying with the Minnesota
Rules of Professional Conduct 4.4 (a) and 8.4 (d), and its potential for
adversely impacting the practice of law, and solutions.
