Understanding Implicit Bias and Its Impact
Traditional thought held that discrimination was always the result of conscious and deliberate conduct. Current research has established that all human beings are biased toward something, somebody, or some group, and that these biases are normal and unintentional. This research gives us awareness that implicit bias exists, and that is a step in the right direction to reduce its influence on our decisions within the scope of the Minnesota Rules of Professional Conduct 4.4 (a) and 8.4 (d), and its potential for adversely impacting the practice of law.
